These Terms and Conditions govern participation in the Khimaira Studios 25 Year Anniversary Website Offer (“the Offer”) by Khimaira Studios ltd (“Khimaira Studios”). By applying for or accepting the Offer, the client agrees to the Terms outlined below.

1. The Offer

1.1 To celebrate the 25th anniversary of Khimaira Studios (2001–2026), the company is offering a promotional website design and build service at no design cost, subject to the conditions outlined in these Terms.

1.2 The Offer includes the design and development of a four (4) page informational website only.

1.3 The pages included in the Offer are limited to:

  • Home
  • About Us
  • Gallery
  • Contact

1.4 The Offer is available for a limited number of clients, as determined by Khimaira Studios.

1.5 Khimaira Studios reserves the right to withdraw, modify, or end the Offer at any time without prior notice.

2. Hosting Requirement

2.1 All websites created under this Offer must be hosted with Khimaira Studios.

2.2 Hosting is provided at a cost of £140 per year.

2.3 Hosting must be paid annually in advance before development begins.

2.4 The hosting package provided under this Offer includes the following specifications:

  • 40GB website storage
  • Unlimited email accounts
  • Unlimited bandwidth
  • SSL certificate
  • Email or text support
  • 99.9% uptime target

2.5 The hosting service is intended for standard business websites built under the anniversary offer and may not be used for high-resource applications or services that exceed normal website usage.

2.6 Failure to renew hosting may result in website suspension or removal.

2.7 Hosting fees are non-refundable once the service has commenced.

2.8 While Khimaira Studios aims to provide 99.9% uptime, uptime is not guaranteed and may occasionally be affected by maintenance, infrastructure issues, or third-party service interruptions.

2.9 Khimaira Studios reserves the right to suspend or limit services if the hosting account is used for activities that negatively impact server performance, security, or other hosted clients.

3. Scope of Work

3.1 The Offer covers the design and development of a standard informational website only.

3.2 The following services are included:

  • Website design
  • Website development
  • Mobile responsive layout
  • Contact form setup
  • Basic on-page SEO configuration
  • Domain connection
  • One (1) revision round

3.3 The Offer does not include:

  • E-commerce functionality
  • Membership systems
  • Custom web applications
  • Booking systems
  • Third-party integrations
  • Copywriting services
  • Graphic design or logo design
  • Photography or media creation
  • Additional revisions beyond the included revision

3.4 Any additional features or services requested outside the scope of the Offer may be quoted separately at standard rates.

3A. Domain Names

3A.1 Domain names are not included in the anniversary website offer.

3A.2 If the client does not already own a domain name, Khimaira Studios can register one on the client’s behalf at an additional cost.

3A.3 Current domain registration prices are:

  • .com domain: £10.90 per year
  • .co.uk domain: £6.50 per year

3A.4 Domain registration fees must be paid in advance before registration.

3A.5 Domain prices may change depending on registrar pricing or availability.

3A.6 If the client already owns a domain name, they are responsible for providing access to the domain registrar or updating the DNS settings so the domain can be connected to the hosting service.

3A.7 Khimaira Studios is not responsible for domain availability and cannot guarantee that a requested domain name will be available at the time of registration.

4. Client Responsibilities

4.1 The client is responsible for providing all website content, including but not limited to:

  • text copy
  • images
  • business information
  • contact details
  • branding materials

4.2 Khimaira Studios does not provide copywriting or content creation under this Offer unless agreed separately.

4.3 The client confirms that all materials provided:

  • are owned by the client or properly licensed
  • do not infringe any copyright, trademark, or intellectual property rights

4.4 The client accepts full responsibility for the legality and accuracy of all content supplied.

5. Revisions

5.1 The Offer includes one (1) revision round.

5.2 A revision round means a single list of changes submitted by the client at one time.

5.3 Additional revisions requested after the included revision may be charged at standard hourly rates.

6. Project Timeline

6.1 Development will begin only after hosting payment has been received and all required content has been supplied.

6.2 Project timelines may vary depending on:

  • content delivery
  • client responsiveness
  • technical factors

6.3 Khimaira Studios is not responsible for delays caused by late content submission or lack of client communication.

7. Right to Refuse Projects

7.1 Khimaira Studios reserves the right to decline any project at its sole discretion.

7.2 Projects may be declined for reasons including but not limited to:

  • illegal activities
  • offensive or harmful content
  • adult content
  • gambling services
  • high-risk or unethical industries
  • projects outside the intended scope of the Offer

8. Intellectual Property

8.1 Upon completion of the project and payment of hosting fees, the client is granted the right to use the website for their business purposes.

8.2 Khimaira Studios retains the right to:

  • display the website in its portfolio
  • reference the project for marketing purposes

8.3 Any proprietary systems, frameworks, or tools used during development remain the intellectual property of Khimaira Studios.

9. Website Maintenance

9.1 Hosting includes basic technical maintenance only.

9.2 Ongoing content updates, feature additions, or design changes are not included.

9.3 Additional maintenance services may be offered under separate agreements.

10. Liability

10.1 Khimaira Studios shall not be liable for any indirect, incidental, or consequential damages arising from the use of the website.

10.2 Khimaira Studios does not guarantee:

  • search engine rankings
  • website traffic
  • business results

10.3 While reasonable efforts are made to ensure reliability, Khimaira Studios is not responsible for downtime caused by third-party services, hosting infrastructure issues, or internet failures.

11. Termination

11.1 Khimaira Studios reserves the right to terminate participation in the Offer if:

  • the client breaches these Terms
  • the client fails to provide content
  • the client behaves abusively or unreasonably
  • the project scope changes significantly

11.2 In such cases, hosting fees remain non-refundable.

12. Governing Law

12.1 These Terms and Conditions shall be governed by and interpreted in accordance with the laws of England and Wales.

12.2 Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

13. Acceptance

By applying for or accepting this Offer, the client confirms that they have:

  • read these Terms and Conditions
  • understood them
  • agreed to be bound by them.

14. Client Content Deadline

14.1 The client must provide all required website content before development can begin.

14.2 Once the project is accepted, the client will have thirty (30) calendar days to provide all required content.

14.3 If the client fails to provide the required content within thirty (30) days, the project may be cancelled at the sole discretion of Khimaira Studios.

14.4 If the project is cancelled due to failure to provide content:

  • the promotional website build will be forfeited
  • the anniversary offer will no longer apply to the client

14.5 Any hosting fees already paid are non-refundable, as hosting resources and administrative work will have already been allocated.

14.6 If the client wishes to proceed with the website after the deadline has passed, the project may be subject to standard website development pricing rather than the anniversary promotion.

14.7 Khimaira Studios reserves the right to reallocate the promotional slot to another client if the content deadline is not met.

15. Fair Usage Policy

15.1 The hosting services provided under the Khimaira Studios 25 Year Anniversary Website Offer are intended for standard small business websites.

15.2 While the hosting package includes unlimited bandwidth and unlimited email accounts, these resources are subject to fair usage to ensure stable performance for all hosted clients.

15.3 Hosting accounts must not be used for activities that place excessive or abnormal load on server resources, including but not limited to:

  • file storage unrelated to the website
  • large file distribution or download services
  • video or media streaming services
  • backup storage services
  • email spam or bulk email campaigns
  • cryptocurrency mining
  • automated scripts or applications that significantly impact server performance

15.4 Websites that generate unusually high traffic or consume excessive server resources may require migration to a higher hosting plan or a dedicated hosting solution.

15.5 Khimaira Studios reserves the right to temporarily suspend, limit, or restrict services if a hosting account is found to negatively affect server stability, security, or the performance of other hosted websites.

15.6 Khimaira Studios will make reasonable efforts to notify the client before taking action, unless immediate action is required to protect server infrastructure or other users.
